Our Business Process
Inquiry & Initial Contact
Clients can reach Joyful Mediation through our website, email, phone, or referral from an attorney, court, or community organization.
During the initial contact, we:
• Gather basic information about the dispute.
• Explain the mediation process and confidentiality standards.
• Schedule an initial consultation or mediation session.
Consultation & Case Intake
A free or low-cost consultation is offered to assess suitability for mediation.
During intake, we:
• Identify the issues to be addressed.
• Confirm that all parties are willing to participate voluntarily.
• Explain fees, scheduling, and mediation guidelines.
• Send each party an Agreement to Mediate and Confidentiality Form to review
and sign.
Preparation for Mediation
Before the session, each party may be asked to:
• Provide any relevant documents or background information.
• Prepare a list of issues and desired outcomes.
• Review ground rules for respectful communication.
The mediator prepares by reviewing materials and setting up either an in-person or
virtual session through Zoom or a secure meeting space.
Mediation Session
The mediation process typically includes:
• Introduction: The mediator explains the process, confidentiality, and ground rules.
• Opening Statements: Each party has an opportunity to share their perspective without interruption.
• Discussion & Issue Identification: The mediator helps clarify concerns and
prioritize topics.
• Negotiation & Option Building: The parties explore possible solutions, with
the mediator facilitating constructive dialogue.
• Agreement Formation: Once consensus is reached, terms are summarized into a
written Mediation Agreement or Memorandum of Understanding (MOU).
Drafting & Finalizing Agreements
After mediation, the mediator prepares a written agreement summarizing the terms reached. Parties review and approve the agreement. If necessary, the document can be submitted to attorneys or the court for final approval. Copies are provided to all participants for their records.
Payment & Documentation
Payment is due as agreed upon in the mediation contract — typically per party, per session. Invoices and receipts are provided for all services rendered.
